Terms and Conditions

1. Definition

In these Terms and Conditions, the following terms shall have the respective meanings specified below unless the context otherwise requires:

  • “Advertiser(s)” means users who place advertisements on the Site;
  • “Applicant(s)” means users who seek products, services or employment opportunities offered by Advertisers on the Site;
  • “Sahakumit” means the trading name of the company known as Sahakumit;
  • “Site” means any website or mobile application owned and operated by Sahakumit and its affiliates and/or subsidiaries.

The terms “you”, “user”, and “users” refer to all individuals and/or entities accessing and/or using the Site at any time for any reason or purpose.

2. Acceptable Site Uses

2.1 Specific Uses – Applicant

Applicants agree that they shall use the Site for lawful purposes only, including seeking digital contents, products, services, and employment opportunities.

Applicants confirm and acknowledge that they disclose personal data and all other information to Advertisers and/or Sahakumit of their own volition when applying for opportunities posted on or through the Site. By submitting, uploading, or posting information on the Site, Applicants authorise Sahakumit to store such information in the Sahakumit database (“Database”).

Applicants acknowledge that their information may be accessed by Advertisers using Sahakumit’s services to assess suitability. Sahakumit reserves the right to reject, edit, or erase any information it reasonably believes to be inaccurate, false, illegal, or infringing upon third-party rights.

Sahakumit will not release Applicants’ personal data to Advertisers without permission unless required by law. Sahakumit may use anonymised personal data for marketing purposes.

Although Sahakumit uses reasonable efforts to restrict access to the Database, it does not guarantee that unauthorised access will not occur. Applicants accept that all information provided is submitted at their own risk.

2.2 Specific Uses – Advertiser

Advertisers agree to use the Site only for lawful sales, marketing, and recruitment purposes.

Upon payment of applicable service fees, Advertisers may post advertisements and access the Database solely for assessing Applicant suitability. Advertisers must not disclose Applicant data to third parties without prior consent.

Advertisers are solely responsible for their advertisement content. Sahakumit reserves the right to remove, edit, suspend, or terminate advertisements or accounts at its sole discretion.

Sahakumit may change service fees or introduce new charges at any time.

2.3 Prohibited Uses – Users

Users shall not:

  • Submit false, misleading, or incomplete information;
  • Use the Site for political, unlawful, or unauthorised purposes;
  • Infringe intellectual property or privacy rights;
  • Upload harmful, defamatory, obscene, discriminatory, or illegal material;
  • Disrupt Site security or functionality;
  • Use data scraping, bots, or automated tools without written consent.

3. Intellectual Property Rights

All content on the Site (“Contents”) is the intellectual property of Sahakumit or its licensors and is protected by applicable intellectual property laws. Users may only download or copy Contents for personal, non-commercial use unless otherwise permitted.

4. Responsibility

Sahakumit may monitor the Site but is not obligated to do so. Users are fully responsible for all materials they submit. Sahakumit is not an agent of Advertisers or Applicants.

The Site is provided “as is” and “as available” without warranties of any kind.

5. Own Risk

All use of the Site is at users’ own risk. Sahakumit does not guarantee the accuracy or reliability of user-generated content and reserves the right to remove inappropriate material at its discretion.

6. Links to Other Websites

Sahakumit is not responsible for third-party websites linked from the Site. Users access such websites at their own risk.

7. Indemnity

Users agree to indemnify and hold harmless Sahakumit and its officers, employees, and affiliates against all claims arising from their use of the Site or breach of these Terms.

8. Disclaimer

To the fullest extent permitted by law, Sahakumit shall not be liable for any damages arising from use or inability to use the Site or its contents.

9. Dealing with Advertisers

All dealings between users and Advertisers are solely between those parties. Sahakumit bears no responsibility for such dealings.

10. Termination

Sahakumit may suspend or terminate any user account at any time without notice if these Terms are breached.

11. Modification to Access or Site

Sahakumit reserves the right to modify, suspend, or discontinue any aspect of the Site at its sole discretion.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Cambodia.

Any dispute shall be resolved by arbitration at the Singapore International Arbitration Centre (SIAC) under SIAC Rules. One arbitrator shall be appointed by the Chairman of the SIAC.

13. Variation of Terms

Sahakumit may vary these Terms at any time by publishing the updated Terms on the Site. Continued use constitutes acceptance.
